Mediation and Arbitration
Alternative Dispute Resolution methods include arbitration, mediation, and collaborative law. ADR offers parties a cost-effective way to craft a creative solution in a timely manner. At Bell, Davis & Pitt, several of our experienced lawyers are certified as mediators through the North Carolina Dispute Resolution Commission, serve as arbitrators, and are trained in the collaborative law process.
Our team frequently mediates matters in both Superior Court and District Court in North Carolina in the following areas:
- Commercial Litigation
- Business Law
- Construction
- Employment Disputes
- Trust, Estate and Fiduciary Litigation
- Personal Injury
- Professional Liabilities
- Real Estate
- Divorce and Family Law
Our attorneys are committed to finding the best possible outcome for the parties involved while mitigating the amount of time, money and stress that typically accompany litigation. We regularly facilitate pre-suit mediation, court-order mediation, and voluntary mediation.
In addition to mediation, arbitration, and collaborative law services, our ADR practitioners provide early neutral evaluation (“ENE”) services to help the parties focus on the issues in a dispute from the outset and evaluate the merits of the claims. Our experienced mediators also offer neutral case management services in multi-party disputes where the parties need the assistance of a neutral facilitator throughout the course of the pending litigation process. We can help facilitate discussions around procedural issues and resolve discovery issues with an eye toward putting the dispute in the best position to reach a resolution short of trial.
With offices in Charlotte and Winston-Salem, Bell, Davis & Pitt attorneys frequently are called upon to mediate disputes throughout North Carolina and South Carolina, including in Forsyth, Mecklenburg, Gaston, Union, Cabarrus, Iredell, Buncombe, Cumberland, Moore, Davidson, Davie, Yadkin, Surry, Stokes, Guilford and York counties.
