D. ANDERSON CARMEN
Andy Carmen focuses his practice on construction law matters, creditor representation, and service as a mediator and arbitrator.
Andy joined the Bell, Davis & Pitt team in 1985. Prior to that, he worked as a judicial law clerk in the U.S. District Court for the Middle District of North Carolina – first for the Honorable Russell A. Eliason, U.S. Magistrate, and then for the Honorable Hiram H. Ward, Chief U.S. District Court Judge.
Andy is a former Chapter 7 bankruptcy trustee, has been a certified mediator since 1996, and is trained in collaborative law. His principal areas of practice are:
- Construction law matters, providing a broad range of services to contractors, designers, subcontractors, suppliers, and owners, including contract drafting and negotiation, lien and bond claims, and construction and design defect claims and defenses
- Creditor representation, including collections, asset recoveries and disputes, bankruptcy claims, and adversary proceedings and litigation
- Service as a mediator and arbitrator, primarily in construction, commercial and bankruptcy disputes.
Andy is involved in community and professional activities. He weekly visits a Title I elementary school as a reading volunteer. He served with the YMCA of Northwest North Carolina in various volunteer and board capacities for more than 15 years, and was an assistant Scoutmaster with the Boy Scouts of America. He has served two terms as a council member of the Construction Law Section of the North Carolina Bar Association, and previously served on the Dispute Resolution Section Council.
Andy grew up in Alamance County, the son of an architect and a teacher. He received his undergraduate degree from North Carolina State University and his law degree from Wake Forest University. He and his wife, Sheila, have three grown children. Away from the office, he enjoys family time, hiking, backpacking, and sailing.

REPRESENTATIVE EXPERIENCE
Representation of bridge contractor in lawsuit following contested claim, resulting in elimination of liquidated damages and recovery of delay damages.
Most recent representation of general contractors in two arbitration proceedings, in pursuit of claims and defense of counterclaims, resulted in awards to clients of 100% of amounts claimed, and reduction of counterclaims by approximately 92%.
Representation of business in tax refund lawsuit resulting in recovery of taxes in excess of $14 million.
